Family Court of Australia and Federal Circuit Court of Australia – Special Arrangements to deal with Coronavirus


The Family Court of Australia and Federal Circuit Court of Australia continue to operate during the crisis.  The Courts have modified the way in which they operate to maintain the health and safety of the community, the Judges and the staff.  The Court is attempting to ensure that all urgent and priority matters are able to be dealt with safely but ensuring that the process incorporates appropriate social distancing.  The Court has indicated that there will be further changes to its operations if required.

Registrars Lists – Divorce

  1. Effective Divorce Applications will be dealt with by telephone to the greatest extent possible – effective from 19 March 2020.
  2. Joint Applications will be heard by the Registrar on the paperwork and the parties will not be required to attend Court.
  3. Individual Applications where there are no children will be dealt with without the parties present.  If there are children under the age of 18 attendance should be by way of telephone and the parties requested not to attend Court.

Family Court of Australia Directions Lists

All Family Court Registrar Directions’ Lists will be conducted by telephone and there will be no requirement to attend Court in person.  In circumstances where a matter is contested, written submissions are to be filed at the Direction of the Registrar and orders will be made in chambers.

Conciliation Conferences

All Conciliation Conferences and Case Assessment Conferences will be conducted by telephone.  The preparation requirements will remain the same.  There will be no requirement to attend Court in person.

Child Dispute Conferences and Child Inclusive Conferences

– All conferences will now be conducted by telephone.

Family Reports

Family report interviews will be conducted and interviews will proceed as arranged unless the Court otherwise advises.

Filing of documents at Court

The Court has directed that all documents including Affidavits be e-filed.  If this is not possible, documents are to be emailed to the Registry of the Court for electronic filing.


The Court’s requirement in relation to how Affidavits are prepared and executed have been modified and relaxed in circumstances where parties may not be able to access a Justice of the Peace or a Solicitor to have their documents witnessed.
