Watson and Watson received an enquiry from Robert in late 2015 in relation to the division of property following his separation from his wife in September 2015. The Husband and Wife each of whom were employed professionally were married for approximately 5 years before separation.
Robert advised Richard Watson that he and his wife wished to if at all possible, resolve the matter amicably.
Prior to the Marriage the Husband and Wife entered into a document referred to as a Binding Financial Agreement. There were some issues as to its effect and enforceability of that document as a Binding Financial Agreement.
Dennis Grant of Watson & Watson a very experienced Solicitor in all matters relating to family law considered the facts and matter and gave Robert advice as to his options, alternatives and likely outcome.
The parties gave full disclosure relating to their financial position through their respective lawyers to each other. The Wife instructed a competent firm of Lawyers to assist in the negotiations.
The property including family home, other real estate, superannuation and their liabilities included some significant loans.
With the assistance of competent Lawyers and with the good will to attempt to resolve the matter the parties were able to resolve their differences and separate the assets and liabilities between them. The matter has resolved amicably within a period of a few months.
The experience of the team at Watson & Watson allowed us to consider the facts and the likely outcome, the available alternatives and negotiate and document in the appropriate form the resolution so as to achieve a costs effective resolution for Robert.
In this case the appropriate documentation of the resolution was a Building Financial Agreement with ancillary documents to protect our client.
